By accessing and using BHK Property's website (bhkproperty.in) and mobile application, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. About BHK Property

BHK Property (Property Bazaar) is a real estate services platform that:

  • Helps customers buy, sell, invest, and resell movable and immovable properties
  • Provides value-for-money property deals
  • Operates primarily in Mohali and Chandigarh, serving all of India
  • Founded in 2022 with a mission to provide best deals to customers

3. User Responsibilities

As a user of our platform, you agree to:

  • Accurate Information: Provide accurate, current, and complete information
  • Legal Use: Use our services only for lawful purposes
  • Account Security: Maintain the confidentiality of your account credentials
  • Respectful Conduct: Interact respectfully with our staff and other users
  • No Fraud: Not engage in any fraudulent or misleading activities
  • Intellectual Property: Not copy, reproduce, or misuse our content without permission

4. Services Provided

4.1 Property Services

We offer:

  • Property buying and selling assistance

  • Agreement of sale to registry assistance
  • Documentation verification and support

4.2 Service Limitations

Please note:

  • We act as intermediaries and facilitators
  • We do not own or directly sell properties listed on our platform
  • Services are subject to availability and our acceptance
  • We reserve the right to refuse service to anyone

5. Fees and Payments

5.1 Service Fees

  • A nominal service fee may be charged for certain services
  • Token money is required for property bookings
  • All fees will be clearly communicated before collection
  • Fees are as per the services availed

5.2 Token Money

  • Token money is charged to secure property bookings
  • Token money is NON-REFUNDABLE
  • Token ensures your booking priority
  • Terms of token money will be explained before payment

5.3 Payment Methods

We accept payments through authorized payment gateways. All payment information is processed securely by third-party payment processors. We use Google reCAPTCHA for fraud prevention and security.

6. Property Listings

Regarding property listings on our platform:

  • Listings are provided by property owners, sellers, or authorized agents
  • We make reasonable efforts to verify listing accuracy
  • We are not responsible for errors or omissions in listings
  • Property availability, prices, and details are subject to change
  • Images shown may vary from actual property conditions

7. Documentation and Verification

We provide support for:

  • Document verification and checking
  • Agreement of sale preparation
  • Registry assistance
  • Due diligence on property papers

However, you are responsible for:

  • Conducting your own independent legal verification
  • Consulting with your own legal advisors
  • Final decision-making regarding property transactions

8. Intellectual Property Rights

All content on our platform, including:

  • Text, graphics, logos, images
  • Software, tools, and features
  • Design, layout, and arrangement
  • Trademarks and branding

...are owned by BHK Property or our licensors and are protected by intellectual property laws. Unauthorized use is prohibited.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We provide services "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • We are not responsible for disputes between buyers and sellers
  • We are not liable for property defects, title issues, or legal problems
  • Our total liability is limited to the service fees paid by you
  • We are not liable for service interruptions, errors, or technical issues
  • We are not responsible for property valuation accuracy or market fluctuations
  • We are not liable for transactions conducted outside our platform
  • Images and descriptions are provided by sellers and may not reflect current property conditions

10. Indemnification

You agree to indemnify and hold harmless BHK Property, its officers, employees, and agents from any claims, losses, damages, or expenses arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any property transaction disputes

11. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

12. Termination

We reserve the right to:

  • Terminate or suspend your access immediately for any reason
  • Remove any content or listings at our discretion
  • Refuse service to anyone at any time

You may stop using our services at any time.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mohali/Chandigarh, India.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. User-Generated Content and Property Listings

17.1 User Submissions

When users (including dealers/partners) submit property listings:

  • You warrant that all information provided is accurate and you have the legal right to list the property
  • You grant BHK Property a non-exclusive, worldwide license to display, reproduce, and distribute your content
  • You are responsible for ensuring property descriptions do not contain prohibited content (mobile numbers, email addresses in descriptions)
  • Listings containing false information, misleading claims, or unauthorized properties may be removed without notice
  • Contact information will be displayed as provided or may be replaced with our official contact number (+91-7888998466) for user protection

17.2 Property Approval Process

  • All property listings are subject to admin approval before going live
  • We reserve the right to edit, modify, or reject any listing for quality, legal, or policy compliance
  • Approval typically takes 24-48 hours but may vary
  • Rejected listings will include a reason for rejection when applicable

17.3 Listing Expiration and Renewal

  • Property listings have defined expiration periods based on the selected plan
  • Expired listings are automatically removed from public view
  • Users will be notified before listing expiration
  • Renewal options are available at prevailing rates
  • No refunds are provided for early removal or expired listings

18. Dealer/Partner Program

18.1 Partner Registration

  • Dealers must register through our official partner program
  • Each dealer receives a unique dealer code for property identification
  • Partner accounts are subject to verification and approval
  • Listing periods are defined per partner agreement (typically 1-24 months)

18.2 Partner Responsibilities

  • Partners must maintain accurate and up-to-date property information
  • Partners are responsible for legal compliance of their listings
  • Partners must respond promptly to inquiries about their properties
  • Partners must not use the platform for fraudulent or misleading activities
  • Property IDs must follow the format: [DEALER_CODE]-[PROPERTY_NUMBER]

18.3 Account Suspension and Termination

We may suspend or terminate partner accounts for:

  • Violation of these Terms
  • Fraudulent listings or activities
  • Non-payment of applicable fees
  • Complaints from users or other partners
  • Any conduct detrimental to our platform or users

19. User Account and Authentication

19.1 Account Creation

  • Users must register with valid email and mobile number
  • Each user receives a unique User ID (format: USR[8-character code])
  • Users must be at least 18 years old to create an account
  • One person may maintain only one active account

19.2 Account Security

  • You are responsible for maintaining the confidentiality of your password
  • You must notify us immediately of any unauthorized account access
  • We are not liable for losses due to unauthorized account use
  • Session cookies and authentication tokens are used for security

19.3 Account Deactivation

  • Users may request account deactivation by contacting support
  • Deactivated accounts may retain data for legal and operational purposes
  • Active property listings will be removed upon account deactivation
  • We reserve the right to deactivate accounts that violate these Terms

20. Payment Processing for User Listings

20.1 Listing Plans and Pricing

Property listing plans are available as follows:

  • 1 Month - ₹100
  • 2 Months - ₹200
  • 3 Months - ₹300
  • 6 Months - ₹600
  • 12 Months - ₹1,200

Prices are subject to change. Current pricing applies at the time of purchase.

20.2 Payment Methods

  • Payments are accepted via UPI and online payment gateways
  • Users must upload payment screenshot for verification
  • Payment verification may take up to 24-48 hours
  • Properties are published only after successful payment verification

20.3 Refund Policy

Important:

  • All listing fees are NON-REFUNDABLE once payment is processed
  • Refunds may be considered only in case of technical errors on our part
  • No refunds for property not selling or receiving inquiries
  • No refunds for early removal of listings at user's request
  • Service interruptions beyond our control do not qualify for refunds

21. Prohibited Activities

Users are strictly prohibited from:

  • Listing properties without legal authorization or ownership rights
  • Providing false, misleading, or inaccurate property information
  • Manipulating property prices or creating artificial scarcity
  • Using automated tools, bots, or scripts to access our platform
  • Scraping, crawling, or harvesting data from our website
  • Attempting to reverse engineer or decompile our software
  • Interfering with the platform's security features or functionality
  • Uploading viruses, malware, or malicious code
  • Impersonating other users, dealers, or our staff
  • Harassing, threatening, or abusing other users
  • Using the platform for illegal activities or money laundering
  • Circumventing payment systems or fee structures
  • Creating multiple accounts to abuse services or promotions
  • Posting discriminatory content based on race, religion, caste, gender, or any protected category

22. Content Moderation and Removal

22.1 Content Standards

  • All content must comply with Indian laws and regulations
  • Property descriptions must not contain obscene, defamatory, or offensive material
  • Images must accurately represent the property
  • Contact information in descriptions is prohibited for user safety

22.2 Reporting Violations

Users can report inappropriate content or violations through:

22.3 Content Removal

We reserve the right to remove content that:

  • Violates these Terms & Conditions
  • Infringes intellectual property rights

  • Is deemed inappropriate by our moderation team

23. RERA Compliance and Disclosure

In compliance with Real Estate (Regulation and Development) Act, 2016:

  • We encourage all property developers and sellers to provide RERA registration numbers
  • Properties under construction should display RERA registration details
  • We are not responsible for verifying RERA compliance of listed properties
  • Users are advised to independently verify RERA registration before transactions
  • We recommend consulting legal advisors for RERA-related matters

24. Geographic Service Area

While our platform is accessible nationwide:

  • Primary service areas: Mohali, Chandigarh, and Punjab
  • Properties from all Indian states and cities can be listed
  • International properties are not currently supported
  • Service quality and response times may vary by location
  • Some services may be limited to our primary service areas

25. Third-Party Links and Services

Our platform may contain links to third-party websites or services:

  • We are not responsible for content on external websites
  • Third-party terms and privacy policies apply to their services
  • Payment processing may involve third-party payment gateways
  • YouTube video links are embedded for property tours (subject to YouTube Terms)
  • We do not endorse or guarantee third-party services

26. Mobile Application and Progressive Web App

If you access our services through mobile applications:

  • App-specific terms may apply in addition to these Terms
  • Service workers and offline functionality may cache data locally
  • Push notifications require user permission and can be disabled
  • App updates may be required for continued access
  • Mobile data charges from your carrier may apply

27. Dispute Resolution

27.1 Informal Resolution

Before pursuing legal action, parties agree to attempt informal resolution by contacting our support team.

27.2 Mediation and Arbitration

  • Disputes may be resolved through mediation or arbitration
  • Arbitration shall be conducted in Mohali/Chandigarh
  • Arbitration shall be governed by the Arbitration and Conciliation Act, 1996
  • Each party shall bear its own costs unless otherwise determined

27.3 Limitation Period

Claims must be filed within one year from the date the cause of action arose.

28. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including:

  • Natural disasters (earthquakes, floods, pandemics)
  • Government actions, laws, or regulations
  • War, terrorism, or civil unrest
  • Internet service provider failures or cyber attacks
  • Power outages or telecommunications failures
  • Labor strikes or disputes

29. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and BHK Property, superseding any prior agreements or understandings.

30. Language

These Terms are provided in English. In case of any translation, the English version shall prevail in case of conflicts or discrepancies.

31. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.

32. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

33. Survival

Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnity, and limitations of liability) shall survive termination of these Terms.

34. Compliance with Laws

Users must comply with all applicable laws, including:

  • Information Technology Act, 2000
  • Indian Penal Code, 1860
  • Real Estate (Regulation and Development) Act, 2016
  • Transfer of Property Act, 1882
  • Indian Contract Act, 1872
  • Consumer Protection Act, 2019
  • Prevention of Money Laundering Act, 2002

Agreement

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
